Nature of the Service
HIBI ("Service") is a service for symbolically and commemoratively recording precious moments including rainbows and other memories. Registration does not confer any legal ownership, rights, or other legal effect over any natural phenomenon, subject, location, or moment.
π Digital Recording
By registering a photo, the following terms apply. Please read carefully before registering.
- β¦Your photo, name, and location will be recorded in HIBI's database. You may delete your own works at any time from your account page.
- β¦Approved works are visible in the gallery to anyone. Works pending review are only visible to you.
Exhibition & Display License
By registering a work, you grant HIBI a non-exclusive, royalty-free, worldwide license to use that work for the following purposes only:
- β¦Display and publication in HIBI's digital archive and museum
- β¦Exhibition at real-world gallery events organized or affiliated with HIBI
- β¦Display on digital signage in partner stores and facilities affiliated with HIBI (excluding resale or individual sale of works)
- β¦Use in HIBI's promotional and communications materials (SNS, press, etc.)
- β¦Internal use for service improvement and development
Copyright remains with the original creator. This license does not include resale or transfer to third parties outside the service. Works set to private are excluded from exhibition and promotional use.
Disclaimer
This Service is provided "as is." We make no warranties regarding continuity, accuracy, or completeness. We are not liable for any direct or indirect damages arising from use of this Service.
Personal Information
Personal information collected at registration (location data, photos, email address, etc.) is used solely for providing the Service and will not be shared with third parties.
Pricing
All features for users (photo registration, gallery display, artist page) are completely free. The digital signage display service for partner stores is a paid service. Contact info@hibiart.jp for details.
Governing Law
Disputes regarding the use of this Service shall be governed by Japanese law, with the Tokyo District Court as the exclusive court of first instance.
